Terms of Service

1. Acceptance of Terms

By accessing or using Braisery's website, mobile applications, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use Braisery. If you are between 13 and 18, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Your Account

To use certain features, you must create an account with a valid email address, a unique username, and a password of at least 8 characters. You may also sign in using Google or Apple.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and up-to-date information and to notify us promptly of any unauthorized use.

You may not create an account using someone else's identity, use an offensive or misleading username, or operate multiple accounts for deceptive purposes.

4. Subscriptions & Billing

Braisery offers a free tier and a paid Pro subscription. The free tier includes limited recipe creation (up to 3 recipes), up to 25 saved recipes, and 1 cookbook.

Pro unlocks unlimited recipes, saves, cookbooks, recipe import, and AI-powered recipe adaptation. Pro is available at $5 per month or $50 per year.

New accounts receive a 14-day free trial of Pro features. No credit card is required for the trial.

Paid subscriptions renew automatically at the end of each billing period unless you cancel. You may cancel at any time from your account settings. When you cancel, you retain Pro access through the end of your current billing period.

We reserve the right to change subscription pricing with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice.

5. User-Generated Content

You retain ownership of recipes, images, ratings, comments, and other content you create on Braisery (“Your Content”). By publishing Your Content, you grant Braisery a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content in connection with operating and promoting the Service.

This license continues for as long as Your Content remains on the Service. If you delete Your Content or your account, we will remove it within a reasonable time, except where retention is required by law or where copies have been shared by other users (for example, a recipe saved to another user's cookbook).

You represent that you have the necessary rights to publish Your Content and that it does not violate any third-party rights or applicable laws.

6. Content Licensing

When you create or publish a recipe, you may assign a license to it (for example, Creative Commons CC-BY or CC-BY-SA). Other users must respect the license you choose.

When you adapt another user's recipe, Braisery attributes the original. You are responsible for complying with the license terms of the original recipe when publishing an adaptation.

7. Acceptable Use

You agree not to:

• Post spam, misleading content, or unsolicited promotions.
• Publish plagiarized recipes or content that infringes others' intellectual property.
• Harass, threaten, or abuse other users.
• Upload illegal, obscene, or harmful material.
• Attempt to gain unauthorized access to the Service or other users' accounts.
• Use automated tools to scrape, crawl, or extract data from the Service without our permission.
• Circumvent rate limits, security measures, or access controls.
• Interfere with or disrupt the Service's infrastructure.

8. Content Reporting & Moderation

You may report recipes or content that you believe violates these Terms. Reports are reviewed by our team and may result in content removal or account action.

We are not obligated to monitor all content but reserve the right to remove content or suspend accounts that violate these Terms, at our sole discretion.

9. AI Features

Pro subscribers can use AI-powered recipe adaptation, which uses a third-party AI model to suggest modifications to existing recipes. AI features are limited to 30 adaptations per day.

AI-generated adaptations are suggestions only. They may contain inaccuracies, incorrect measurements, or unsuitable ingredient substitutions. You are solely responsible for reviewing, testing, and verifying any AI-generated recipe before preparing or serving it.

Braisery does not guarantee that AI-generated content is safe, accurate, or suitable for any dietary requirement. Users with food allergies or dietary restrictions should exercise particular caution.

10. Recipe Import

The Service allows you to import recipes from external websites. You are responsible for ensuring that you have the right to use and republish any imported content. Importing a recipe does not transfer ownership or license rights from the original source. Braisery is not liable for any copyright or intellectual property disputes arising from imported content.

11. Intellectual Property

The Braisery name, logo, design, and all platform software are owned by Braisery and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service (other than Your Content) without our written permission.

12. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Recipes on Braisery are created by community members and are not professionally verified. We do not guarantee their accuracy, safety, nutritional information, or suitability for any dietary need.

You assume all risk when preparing or consuming food based on recipes found on the Service.

13. Limitation of Liability

To the maximum extent permitted by law, Braisery and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

14. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our reasonable discretion, with or without notice.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property) will remain in effect.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
